US company sues Nike over ‘Lottery Pick’

According to a lawsuit filed in Illinois, clothing company Urban Motive Sportswear claims it have been selling an energy drink, sportswear apparel and other merchandise for years with the trademark “Lottery Pick”, which it claims it registered 2004. It is now taking sportswear brand Nike to court for using it on a Michael Jordan jacket.

Urban claims Nike stole its trademark by selling a jacket called ‘Jordan LS Lottery Pick Jacket’. They say this violation is particularly hurtful to their business because they did a lot of marketing in Chicago, where Jordan played most of his career.

Urban says this trademark infringement has “damaged [them] in a manner that cannot be fully measured or compensated in economic terms and for which there is not adequate remedy at law”.

They are suing Nike for trademark infringement and seeking unspecified damages. Jordan is not a named defendant.
