Asics files lawsuits over trademark infringements
Athletic footwear and technical active sports apparel and accessories brand Asics America Corporation (Irvine, California) and Asics Corporation Japan (Kobe, Japan) have filed two separate lawsuits in the US District Court, Central District of California, the first against Target Corporation (Minneapolis) and Mossimo, Inc. (Santa Monica) and the other against Target Corporation, Blue Marlin Corporation (San Francisco) and Roma Atletica S.R.L. Unipersonale (Rome). Both lawsuits are for trademark infringement, unfair competition, trademark dilution and false advertising.
Asics is seeking permanent injunctions against the named companies to prevent any future sales and distribution of shoes that bear a stripe design similar to its trademark-protected stripe design. In addition, the company is seeking damages, including profits and legal fees.
The company discovered that Target is currently selling the Roma Atletica Gawain, the Mossimo Gareth and the Mossimo Gryph shoes in its stores and on its website. These shoes are said to display stripes that are ‘confusingly’ similar to its well-known stripe design.
