Collective Brands settles lawsuit with K-Swiss

Collective Brands Inc., which last month paid adidas America $305 million for trademark infringement, has been told it must pay K-Swiss Inc. for $30 million following a similar court case.

Athletic footwear producer K-Swiss started proceedings against Collective Brands Inc – Previously known as Payless ShoeSource – in 2004, asking for an injunction against the firm and monetary damages for trademark infringement, trademark dilution and unfair competition.

Collective has not admitted liability in the settlement and will continue to sell its remaining stock, which was the subject of the lawsuit, until the end of the year. However, it agreed to refrain from making, advertising, promoting or selling footwear "confusingly similar to that sold by K-Swiss".
