Microban celebrates “important victory” in Chinese court

Antimicrobial technology provider Microban has won a judgment against a rival company in China, Greenchem Fine Chemicals Limited for using Microban’s Aegis environmental management trademarks without permission.

Greenchem was a distributor of Microban’s in China until 2013, when the agreement ended. However, Greenchem continued to use the Aegis brand in its sales and marketing materials. A court in the Shanghai district of Putuo has now declared that Greenchem acted unlawfully.

It also found that the Chinese company “secured several fraudulent registrations” for the Aegis trademark in a number of Asian territories during its tenure as a distributor.

According to the court’s decision, Greenchem must now stop using the Aegis trademark registrations, issue a public apology and pay a fine.

“This is an important victory for Microban,” said the company’s senior business director, Lisa Owen, on announcing the development. “Microban has always prided itself on the quality of its products, and we want to maintain the integrity of our brand. Aegis comes from only one place and that is Microban and its authorised distributor network. We could not be more pleased as to how this case was handled in court, and we look forward to putting this market confusion behind us and moving forward with our valued customers and partners.”
