PFAS bans come into effect

Laws voted by the states of California, New York and Colorado banning or restricting the sale of clothing containing PFAS came into effect on January 1st this year.

The New York State ‘PFAS in Apparel’ bill was passed in 2022 and bans the sale of products with “intentionally added PFAS in apparel” starting in 2025. A prohibition of PFAS in “outdoor apparel for severe wet conditions” will come into effect in three years, on January 1st, 2028.

The NY states law defines outdoor apparel as clothing intended for outdoor activities such as hiking, camping, skiing, climbing, bicycling and fishing. It does not include professional uniforms.

The term “outdoor apparel for severe wet conditions” encompasses outdoor apparel that provides protection against extended exposure to extreme rain conditions or against extended immersion in water or wet conditions, such as from snow. In essence, it covers items described as ‘waterproof’ rather than ‘water resistant’.

In California, PFAS used on food packaging has been prohibited since January 1st, 2023, and extended to textiles in 2025 through the state’s Safer Clothes and Textiles Act of 2022.

Since this January, the sale of “outdoor apparel used for severe wet weather and containing intentionally added PFAS” is allowed in Colorado on condition that the items carry a label indicating they “are made with the controversial chemicals”. An full ban on the sale of PFAS in apparel in the state comes into effect on January, 1st 2028.
